Terms and Conditions

About these terms

These terms are an agreement between you and Zedek's Digital ("we", "us"), a business name registered in Ghana, which runs Zedeks. They apply when you use zedeks.com or any of our own products listed under "Product by product" below.

Some products have extra terms on their own page. If a product page and these general terms disagree, the product page wins for that product.

Client projects (software, websites, apps or hosting we design, build or run for you) are covered by the proposal or contract we agree with you. That document wins over these terms.

These terms apply when you use zedeks.com or any of our products, from the date at the top of this page. By using them, you agree to these terms. Where a product asks you to tap or click "I agree", that records your agreement. You must be 18 or older to create an account.

Using the website and our products

Use our website and products lawfully and fairly. In particular, do not:

• break the law, or help anyone else to;
• send spam, scams, or misleading, abusive or harmful content;
• try to get into accounts, systems or data that are not yours, or test our security without our written permission;
• overload, disrupt or reverse engineer our services, except where the law allows it;
• pretend to be someone else, or resell our products without our written permission.

Your account

Give accurate details when you sign up and keep them up to date. Keep your password and API keys secret. You are responsible for what happens under your account. If you think someone else has access to it, tell us at once at support@zedeks.com.

Prices and payment

• Prices are in Ghana cedis (GHS) unless we say otherwise, and are shown in the product before you pay.
• Some products work on prepaid credit: you top up, and credit is used as you go.
• Payments go through Paystack, or by direct Mobile Money or bank transfer where a product offers it. Their terms also apply to the payment.
• If you think a charge is wrong, tell us at support@zedeks.com and we will check it and correct any mistake.
• Free credit, such as starter or invite credit, is a promotion. It has no cash value and cannot be withdrawn. Each promotion sets its own end date, and the credit ends on the date shown when it is given.
• Refunds: where a product sells credit or page bundles, its own page says when you can get a refund. Nothing in these terms takes away any right to cancel or to a refund that you have under Ghanaian law, including the Electronic Transactions Act, 2008 (Act 772).
• The price shown is the full price. We do not add tax or any fee of our own on top.

Your content

What you upload or send stays yours. You give us permission to store, process and send it only as far as we need to provide the product to you.

You are responsible for having the right to use what you send us, for example the copyright in a document, or the consent of the people you message. We may remove content that breaks these terms or the law.

How we handle personal information is explained in our Privacy Policy.

When you handle other people's information

If you use one of our products to handle other people's personal information (for example your SMSGist contacts or your shop's records in GyalaOS), you are the data controller for it and we are your data processor. We will:

• use it only to provide the product to you and on your instructions;
• keep it secure and limit who can reach it;
• tell you without undue delay if a breach affects it;
• delete it or give it back to you when you leave, unless the law requires us to keep it.

You are responsible for having a lawful reason, and any consent needed, to put that information into our products.

AI features

Some of our products, such as Edupah Scribe, use AI to read, type or write. AI can make mistakes. Check every document before you use, print or share it. You are responsible for the final version you use.

Our intellectual property

The website, our products, and their code and designs belong to Zedek's Digital. Zedeks, SMSGist, GyalaOS, SkillsDey, The Butler CI and Edupah are names Zedek's Digital uses for its products. While you follow these terms you may use our products for their intended purpose. Where we publish code under an open-source licence, such as our SDKs, that licence applies to that code.

Pilots and coming-soon products

Products marked "Live pilot" or "Coming soon" are still being built. Access may be limited, and features may change, pause or end. A feature we describe as planned or coming soon is a plan, not a promise.

Availability and support

We work to keep our products running, but we cannot promise they will always be available or free of errors. We may need to pause a product for maintenance or for reasons outside our control. For help, write to support@zedeks.com or call +233 59 887 5617.

Our responsibility to you

As far as the law allows:

• our products are provided "as is";
• we are not responsible for indirect or consequential losses, such as lost profit, lost business or lost opportunity;
• our total responsibility to you for any claim is limited to the greater of what you paid us for the product concerned in the 12 months before the claim, and GHS 500.

Nothing in these terms limits responsibility that Ghanaian law does not allow us to limit, including for fraud or wilful misconduct, or anyone's rights under the Data Protection Act, 2012 (Act 843), or your rights under the Electronic Transactions Act, 2008 (Act 772).

Suspending or closing an account

You can stop using a product at any time. We may suspend or close an account that breaks these terms, does not pay, or puts other people or our services at risk, and where the law requires it. Where it is fair and safe to do so, we will tell you first and give you a chance to put things right.

If we close your account, or end a product, for a reason that is not your fault, we refund your unused bought credit and the unused part of any bundle.

Services run by others

Our products work with services run by other companies, such as Telegram, WhatsApp (Meta), Paystack, Anthropic (our AI provider), the Mobile Money networks and the SMS networks. Their own terms apply when you use them, and we are not responsible for their outages or decisions.

Law and disputes

These terms are governed by the laws of Ghana. If something goes wrong, please write to us first and we will try to resolve it quickly. If we cannot agree, the courts of Ghana sitting in Accra will decide.

Accepting these terms by tapping or clicking "I agree" is a valid way to agree under the Electronic Transactions Act, 2008 (Act 772).

Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell you in the product you use before they apply to you.
